3. Equipment Rental Terms

Rental Period

Care and Maintenance

Customers must:

• Use equipment in accordance with instructions provided
• Maintain equipment in good condition
• Not modify, repair, or relocate equipment without authorization
• Notify us immediately of any malfunctions or damage
• Allow access for scheduled maintenance and filter replacement

Damage and Loss

Customers are responsible for damage to equipment caused by misuse, neglect, or unauthorized modifications. Loss or theft of equipment must be reported immediately. Customers may be liable for repair or replacement costs.

4. Payment Terms

Payment terms will be specified in your service agreement. Generally:

• Rental fees are due monthly
• Installation fees may be charged separately
• Filter replacement is typically included in rental fees
• Late payments may incur additional fees
• We accept payment via check, credit card, or ACH transfer

5. Service and Installation

Our installation and service terms include:

• Customer must provide access to installation location

6. Cancellation and Termination

Customer Cancellation

Customers may cancel rental agreements with 30 days written notice. Equipment must be returned in good condition. No refunds for partial months.

Company Termination

We reserve the right to terminate service for:

• Non-payment or late payment

• Misuse or damage to equipment
• Denial of access for maintenance

7. Warranties and Disclaimers

Equipment Warranty

Water Quality

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUNNINGHAM PURE WATER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM USE OF OUR SERVICES OR EQUIPMENT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY CUSTOMER IN THE SIX MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Cunningham Pure Water LLC, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of any rights of another party.

• NSF/ANSI Standard 58 for reverse osmosis systems
• FDA regulations for materials in contact with drinking water
